What is the California Cottage Food Law, AB 1616?

The California Cottage Food Law, AB 1616, allows individuals to sell certain types of food products made in their home kitchens without the need to obtain a business permit or license. The law went into effect on January 1, 2012. Under the cottage food law, you can sell certain foods that are not potentially hazardous and do not require refrigeration. Among them are baked goods such as breads, cookies and cakes; jams and jellies; fruit tarts; dried fruits and nuts; popcorn; cereals; dry mixes such as soup mixes and trail mixes; granola bars/energy bars; waffle cones/pizza dough; honey combs; sweets (including chocolate); vinegars and mustards; pickled fruits/vegetables (as long as they are suitable for preservation and do not require refrigeration); fruit butters; fruit pastes; and roasted coffee beans.

You can sell your artisanal food products at farmers' markets, roadside stands, public events, or directly to consumers through door-to-door sales or door-to-door orders. You can also sell online, through a Community Supported Agriculture program or any other direct marketing channel. If you choose to sell online, you will need to indicate on the label or packaging the address of the kitchen where the product was prepared.

What can NOT be done

The California Cottage Food Law has some limitations. For example, you may only sell food that you have prepared in your home kitchen with ingredients that have been purchased from a retail establishment (grocery store, farmer. You may not sell food that you have prepared in a commercial kitchen, and you may not use ingredients that you grew or raised yourself, and the total annual gross sales of your cottage food business cannot exceed $50.000.
